AN ORDINANCE RENAMING CERTAIN STREETS AS PLATTED IN THE REPLAT OF BARNSTORMER’S WEST FIELD SUBDIVISION AND EASTLINKS ADDITION TO THE CITY OF MCPHERSON, KANSAS
WHEREAS, there is shown on the Replat Barnstormer’s West Field Subdivision, a portion of the Northwest Quarter of Section 34, T19S, R3W of the 6th PM, McPherson County, McPherson, Kansas, streets named the following: Ryan Court, Ryan Drive, Waco Court, Waco Drive, and Paradise Lane; and
WHEREAS, the governing body of the City of McPherson has determined that portions of such streets should hereafter be renamed; and
WHEREAS, Ordinance No. 3246 passed by McPherson City Commission on July 24, 2017 was incorrect by renaming Calvary Street to Eastlinks Street, when the proper designation of the roadway should have been Eastlinks Drive based upon the nature of the roadway characteristics; and
WHEREAS, a summary of Ordinance No. 3246 was not published in the official city newspaper as a result of identifying the error before the publication was approved and the ordinance never took full effect; and
WHEREAS, Ordinance No. 3247 passed by McPherson City Commission on July 31, 2017 was incorrect by stating the renamed streets were in Barnstormers West Field Addition when it should have been listed in the Replat Barnstormers West Field Addition as the original plat underwent a filed replat; and
WHEREAS, Ordinance No. 3253 passed by the McPherson City Commission on October 9, 2017 and filed with the Register of Deeds on October 18, 2017 in Book 666, page 7563-7564 renamed Calvary Street to Eastlinks Drive, Curtiss Court to Curtiss Circle, Ryan Court to Ryan Circle, and Waco Court to Waco Circle; and
WHEREAS, Ordinance No. 3424 adopted by McPherson City Commission on May 14, 2024 and published on the City’s website was incorrect by stating previous street names therefore making it incorrect and ineligible for filing with the Register of Deeds.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:
Section 1. That “Ryan Court” platted as a part of Replat Barnstormers West Field Subdivision to the City of McPherson, renamed as “Ryan Circle” in Ordinance No. 3253 and Ordinance No. 3247, is hereby renamed and designated “Midway Court,” affecting Lots 36-47, Block A, Replat Barnstormer’s West Field Subdivision.
Section 2. That “Ryan Drive” platted as a part of Replat Barnstormers West Field Subdivision to the City of McPherson, is hereby renamed and designated “Midway Drive,” affecting Lots 1-9, Block E, and Lots 9-16, Block D, Replat Barnstormer’s West Field Subdivision.
Section 3. That “Waco Court” platted as a part of Replat Barnstormers West Field Subdivision to the City of McPherson, renamed as “Waco Circle” in Ordinance No. 3253 and Ordinance No. 3247, is hereby renamed and designated “Golf Green Court,” affecting Lots 48-59, Block A, Replat Barnstormer’s West Field Subdivision.
Section 4. That “Waco Drive” platted as a part of Replat Barnstormers West Field Subdivision to the City of McPherson, is hereby renamed and designated “Golf Green Drive,” affecting Lots 1-9, Block F, and Lots 10-18, Block E, Replat Barnstormer’s West Field Subdivision.
Section 5. That “Paradise Lane” platted as a part of Replat Barnstormers West Field Subdivision to the City of McPherson, is hereby renamed and designated “Eagle Drive,” affecting Lots 10-18, Block F, and Lots 60-65, Block A, Replat Barnstormer’s West Field Subdivision, and Lots 1-9, Block A, and Lot 1, Block B, Eastlinks Addition.
Section 6. After this ordinance becomes effective, the City Clerk shall file an affidavit of publication of this ordinance with the McPherson County Register of Deeds, and shall mail a copy of the affidavit of publication to the McPherson County Appraiser’s office.
Section 7. Repealer. Sections of Ordinance Nos. 3246, 3247, 3253, and 3424 conflicting with the provisions of this Ordinance are hereby repealed.
Section 8. Publication and Effective Date. This ordinance shall take effect and be in full force and effect from and after its passage, signature and publication of the full text of the ordinance on the city’s website in compliance with K.S.A. 12-3007(b).
