RESOLUTION NO. 26-02

A RESOLUTION DELEGATING LIMITED EMPLOYMENT AUTHORITY RELATED TO HIRING AND ADMINISTRATIVE LEAVE

 

WHEREAS, The City Commission of the City of McPherson (“City Commission”) is the governing body of the City and retains ultimate authority over all employment matters; and 

WHEREAS, the City Commission recognizes the need for timely and efficient personnel actions to ensure continuity of operations, protect public service, and maintain effective City operations; and

WHEREAS, the City Commission desires to delegate limited employment authority related to hiring and administrative leave, while expressly retaining final authority over employment decisions. 

NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:

 

Section 1.   Delegating Hiring Authority. The City Administrator, or the Human Resources Department acting at the discretion of the City Administrator, is hereby authorized to:

  1. Extend offers of employment for approved City positions;
  2. Establish starting pay within the City Commission approved job classifications, pay ranges, and budget authority, consistent with the City’s compensation policies and internal equity considerations; and
  3. Administer recruitment, selection, and placement processes consistent with applicable City policies, resolutions, and law.

Section 2. Administrative Leave Authority. The City Administrator, or Human Resources Department at the discretion of the City Administrator, is hereby authorized to place an employee on paid administrative leave when such action is deemed necessary to:

  1. Protect City operations, public safety, or integrity of City services;
  2. Allow for investigation, review, or assessment of allegations or circumstances; or
  3. Maintain orderly operations pending consideration by the City Commission.

Administrative leave under this resolution:

  1. Is non-disciplinary in nature;
  2. Is temporary; and 
  3. Does not constitute termination, suspension without pay, or final disciplinary action.

Section 3. Reserved Authority of the City Commission. The City Commission retains exclusive authority to:

  1. Approve involuntary termination of employment; and
  2. Take final disciplinary action resulting in separation of employment.

Nothing in this resolution shall be construed to alter the at-will employment status of City employees.

Section 4. Administration and Documentation. The Human Resources Department shall:

  1. Document all actions taken pursuant to this Resolution;
  2. Ensure compliance with applicable laws, policies, and City Commission directives; and
  3. Prepare and coordinate materials for City Commission consideration when termination or other final disciplinary action is recommended.

Section 5. Relationship to Existing Policies. This resolution supplements existing City policies and procedures. In the event of any inconsistency between this Resolution and the Employee Handbook or other administrative policies, this Resolution controls unless and until superseded by subsequent City Commission action.

ADOPTED by the governing body this 3rd day of February 2026.
