ORDINANCE NO. 3451
AN ORDINANCE AMENDING A PART OF CHAPTER 2,
ARTICLE VI, OF THE CODE OF THE CITY OF
MCPHERSON, KANSAS (1995) PERTAINING TO THE
TRANSFER TO THE CITY GENERAL FUND OF CERTAIN
MONIES GENERATED BY THE CITY'S BOARD OF
PUBLIC UTILITIES AND REPEALING THE EXISTING
SECTION
WHEREAS, the City Commission of the City of McPherson (the City) has reviewed the
provisions of the Code of the City of McPherson pertaining to the City's regulations on
the transfers to the City general fund of certain monies generated from electrical system
sales by the City's Board of Public Utilities; and
WHEREAS, The City Commission has found and determined that it is necessary to
amend section 2-331(a) of the Code of the City of McPherson, Kansas (2004) (the Code)
in order to revise those provisions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MCPHERSON, KANSAS:
SECTION 1. Amendment of Code Section. From and after the effective date of this
Ordinance, Section 2-33 l(a) shall read as follows:
2-331(a). TRANSFER TO THE CITY GENERAL FUND. The treasurer of the board
of public utilities of the city shall on or before the 45th day following December 31, 2025,
and on or before the 45th day following the close of each three month period thereafter,
transfer and remit to the general fund of the city, an amount of money equal to 3.05 mills
per kilowatt hour (KWH) of net systems send out sales, exclusive of sales to the
interconnection, by the board of public utilities of the city during the period beginning
November 4, 2025, and ending on December 31, 2025, and for each three month period
thereafter.
SECTION 2. Repealer. Existing Section of 2-331(a) and all other parts of the Code
conflicting with the provisions of this Ordinance are hereby repealed.
Section 3. Publication and Effective Date. This ordinance shall take effect and be in full force
and effect from and after its passage, signature and publication of the full text of the ordinance on
the city's website in compliance with K.S.A. 12-3007(b) and the City Code.
