AN ORDINANCE RENAMING A PORTION OF “EBY STREET” AS PLATTED IN MCPHERSON COLLEGE SUBDIVISION TO THE CITY OF MCPHERSON, KANSAS, TO BE KNOWN AS “DONDLINGER DRIVE”
WHEREAS, there is shown on the plat of McPherson College Subdivision to the City of McPherson, Kansas, a street named “Eby Street,” legally described below:
LEGAL DESCRIPTION: A tract of land located in the City of McPherson, McPherson County, Kansas, being a portion of Eby Street right-of-way lying between the intersection of Gordon Street and the intersection of North Baer Street, more particularly described as follows:
Beginning at the intersection of the centerline of Eby Street and the centerline of Gordon Street; thence southerly along the centerline of Eby Street a distance of approximately 201 feet to the intersection with the centerline of North Baer Street; thence easterly and westerly along said centerline of North Baer Street to the east and west right-of-way lines of Eby Street; thence northerly along said right-of-way lines to the point of beginning.
WHEREAS, the governing body of the City of McPherson has determined that such street should hereafter be named “Dondlinger Drive,”
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:
Section 1. That a portion of “Eby Street” platted as a part of McPherson College Subdivision to the City of McPherson is hereby named and designated “Dondlinger Drive.”
Section 2. That a condition of this ordinance is that the applicant, McPherson College, will apply for a vacation of such street in order to take on ownership and maintenance.
Section 3. After this ordinance becomes effective, the City Clerk shall file an affidavit of publication of this ordinance with the McPherson County Register of Deeds, and shall mail a copy of the affidavit of publication to the McPherson County Appraiser’s Office.
Section 4. This ordinance shall be in full force and effect after its passage by a majority of the governing body, signature by the mayor, and publication once in the official City publication of record.
