ORDINANCE NO. 3354
AN ORDINANCE OF THE CITY OF MCPHERSON, KANSAS ADDING CHAPTER 30, ARTICLE I, SECTION 5 OF THE CODE OF THE CITY OF MCPHERSON, KANSAS REGARDING WHEN ANY MASK REQUIREMENT IS EFFECTIVE OR NOT.
WHEREAS, the City of McPherson enacted a mask Ordinance numbered 3342;
WHEREAS, the governing body has determined that it is in the best interest of the public to amend such ordinance so that it can be quickly implemented or suspended depending on rapidly changing circumstances.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:
Section 1. Addition of Code section 30-5. From and after the effective date of this Ordinance, Section 30-5 of the Code of the City of McPherson is hereby added to read as follows:
Sec. 30-5 Effective. Section 30-4 of the Code shall be effective and enforceable at midnight following passage of a simple motion by the governing body and posting of such motion on the City's website and shall remain enforceable until suspended by a simple motion of the governing body which shall also be posted on the City's website. The intent of this Section 5 is to permit the governing body to quickly and efficiently implement the mask ordinance in Section 4 or to suspend it in similar fashion as the circumstances warrant all within the discretion of the governing body. Section 4 is in effective and enforceable at the time of the passage of this ordinance.
Section 2. Repeal All or parts of the Code conflicting with the provisions of this Ordinance are hereby repealed.
Section 3. Publication, Effective Date and End Date. This ordinance shall take effect and be in full force and effect after its passage, signature, and publication of the ordinance on the official city website.
