ORDINANCE NO. 3345
AN ORDINANCE AMENDING A PART OF CHAPTER 86, ARTICLE III, DIVISION 5 OF THE CODE OF THE CITY OF MCPHERSON, KANSAS (2004) PERTAINING TO BASIS FOR SEWER RATES, AND REPEALING THE PORTION THEREOF INCONSISTENT WITH THESE AMENDMENTS.
WHEREAS, the City Commission of the City of McPherson, Kansas (the "City") has reviewed the provisions of the Code of the City of McPherson, Kansas (2004) (the "Code") pertaining to sewer rates; and
WHEREAS, the City Commission has found and determined that it is necessary to raise rates, fees and charges payable by customers of the City's sanitary sewer system, and to amend Section 86-216 of the Code in order to modify the provisions thereof in accordance with the City Commission's findings;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MCPHERSON, KANSAS:
Section 1. Amendment of Code Section 86-216. From and after the effective date of this ordinance, existing Section 86-216 of the Code shall be deleted and in its place, the following shall be inserted:
The base sewer service rate per customer shall be $17 .00, plus $1.87 per 100 cubic feet or $2.50 per 1000 gallons of water used per month during the base period determined as set forth in Section 86-215. All sewer service rates for customers whose premises connected to the City sewer system are outside the corporate limits of the City shall be one-hundred and fifty percent (150%) of the foregoing rates and charges.
The base sewer service rate per individual RV Pad site shall be $8.500, plus $1.87 per 100 cubic feet or $2.50 per 1000 gallons of water used per month during the base period determined as set forth in Section 86-215 and Section 86-214(4). All sewer service rates for individual RV pad sites customers whose premises connected to the City sewer system are outside the corporate limits of the City shall be one-hundred and fifty percent (150%) of the foregoing rates and charges. For clarification, the reduced rate only applies to recreational vehicle pads and does not apply to mobile home pads. If the pad is a mixed use, the pad shall be treated as a mobile home pad.
Section 2. Repealer. All other parts of the Code conflicting with the provisions of the Ordinance are hereby repealed.
Section 3. Publication and Effective Date. This ordinance shall take effect and be in full force and effect from and after its passage, signature and publication of the full text of the ordinance on the city's website in compliance with K.S.A. 12-3007(b) and the City Code and (2) January 1, 2021.
