A RESOLUTION MODIFYING SECTION 9.3 OF THE CITY OF MCPHERSON EMPLOYEE HANDBOOK RELATING TO RESIDENCY REQUIREMENTS FOR CITY EMPLOYEES AND OFFICIALS.
WHEREAS, the governing body of the City of McPherson, Kansas, adopted the Employee Handbook of City of McPherson and McPherson Board of Public Utilities effective April 1, 2006, providing in Section 9.3 a personnel policy and procedure relating to residency requirements for City employees, generally requiring City employees to live within a certain radius of the corporate limits of McPherson, Kansas; and
WHEREAS, the governing body passed a revision of Section 9 on February 11, 2021, modifying the Employee Manual and Supplement Section 9.3 pertaining to residency requirements for sworn police officers to take effect March 1, 2021; and
WHEREAS, the governing body of the City of McPherson now desires to amend the Employee Manual and Supplement Section 9.3 to no longer require all City employees to live within a certain radius of the corporate limits of McPherson, Kansas, but with an exception for certain time and/or safety sensitive positions.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:
Section 1. That the residency requirement for City employees be waived except for the following categories:
- Elected Officials;
- Appointed Officials, except as otherwise allowed by City Code provision 2-82;
- All time and/or safety sensitive positions as deemed such by the applicable department head. However, wastewater employees shall be deemed time and/or safety sensitive.
Section 2. All firefighter residency requirements shall be governed by existing Standing Operating Guidelines as amended from time to time.
Section 3. All sworn police officer’s residency requirements shall be governed by existing General Orders as amended from time to time.
Section 4. If any employee disagrees with the department head’s determination of residency requirements, the governing body member over such department shall make the final determination.
